This volume offers unique insights into the mutually constitutive nature of social media practices and religious change. Part 1 examines how social media operate in conjunction with mass media in the construction of discourses of religion and spirituality. It includes: a longitudinal study of British news media coverage of Christianity, secularism and religious diversity (Knott et al.); an analysis of responses to two documentaries 'The Monastery' and 'The Convent' (Thomas); an evaluation of theories of the sacred in studies of religion and media within the 'strong program' in cultural sociology in the US (Lynch); and a study of the consequences of mass and social media synergies for public perceptions of Islam in the Netherlands (Herbert). Part 2 examines the role of social media in the construction of contemporary martyrs and media celebrities (e.g., Michael Jackson) using mixed and mobile methods to analyse fan sites (Bennett & Campbell) and jihadi websites and YouTube (Nauta). Les médias sociaux font désormais partie intégrante de notre vie. Si les médias sociaux offrent des opportunités en termes de développement des affaires, de recrutement, d’interactions entre collègues de travail, de partage de connaissances et de diffusion d’informations professionnelles, ils imposent également des contraintes à l’employeur qui souhaite en réguler l’usage. Ces médias présentent aussi des risques tant pour l’employeur (atteinte à la réputation, diffusion de données confidentielles) que pour les travailleurs qui diffusent des informations personnelles ou sont l’objet de commentaires de la part de collègues. Une connaissance approfondie du cadre légal existant ainsi qu’une bonne compréhension du fonctionnement des médias sociaux sont les ingrédients nécessaires pour vous protéger contre les risques et abus éventuels. Les services offerts évoluent sans cesse, au point d’être parfois difficiles à cerner et en tout cas à enfermer dans des qualifications juridiques figées tandis que les opérateurs de réseaux se voient de plus en plus amenés à jouer un rôle régulateur de la vie du réseau. Lorsqu’elle est confrontée à la diffusion de messages nuisibles à son image, il est primordial pour l’entreprise de connaître au préalable les diverses possibilités d’actions afin d’adopter une politique de réaction graduée aux atteintes, la rapidité de réaction étant primordiale. L’examen de quelques clauses classiques montre des interrogations parfois essentielles quant à l’insécurité juridique dont elles sont la source. En conclusion, les textes pointent l’absolue nécessité de lever les ambiguïtés et incertitudes avec comme question centrale celle de la protection des libertés citoyennes sur les réseaux avant que ceux-ci ne soient mis en question de façon radicale.

Digital artifacts from iPads to databases pervade our lives, and the design decisions that shape them affect how we think, act, communicate, and understand the world. But the pace of change has been so rapid that technical innovation is outstripping design. Interactors are often mystified and frustrated by their enticing but confusing new devices; meanwhile, product design teams struggle to articulate shared and enduring design goals. With Inventing the Medium, Janet Murray provides a unified vocabulary and a common methodology for the design of digital objects and environments. Pour beaucoup, les réseaux sociaux sont devenus « une machine à outrage » qui rend la vie en ligne beaucoup plus polarisée et plus susceptible d’inciter aux mécanismes de promotion personnelle par l’humiliation et la haine des autres. Le sentiment d’impunité qu’induit l’anonymat en ligne – réel ou fantasmé – encourage sur la toile des comportements déviants, dont les discours de haine, qui n’avaient jamais connu un tel retentissement dans « la vraie vie ».Même si d’autres expressions en ligne posent problème, il nous a semblé pertinent de centrer notre propos sur les contenus haineux dont la prolifération, eu égard aux dommages et aux souffrances qu’ils causent, n’est plus tolérable.Se pose dès lors la question de leur régulation.Au-delà de la complexité à cerner les contours précis du « discours de haine », cette régulation présente diverses difficultés. Notamment, celles liées à l’identification des auteurs. Ceux-ci trouveront, dans l’anonymat et dans les règles protectrices de la vie privée, d’utiles moyens pour échapper à la mise en cause de leur responsabilité. D’autres difficultés se déduisent de la nécessité essentielle de préserver la liberté d’expression des internautes qui vaut aussi et surtout pour les propos qui « heurtent, choquent ou inquiètent ».L’expression écrite d’une opinion, lorsqu’elle est constitutive d’un délit, relève en Belgique du régime spécifique du « délit de presse » et donc de la compétence du jury d’assises. L’écrit numérique n’en est pas exclu. Il s’impose aujourd’hui de s’interroger sur la pertinence de ce régime spécifique pour juger les contenus haineux, au regard notamment des objectifs poursuivis par la mise en place de ce « privilège de juridiction » et de la nécessité sociale à réprimer ces dérives de l’expression.Enfin, se pose la question de la responsabilité des gestionnaires des plateformes en ligne dont le design et les algorithmes favorisent la propagation des contenus haineux.Ce sont toutes ces délicates questions, et bien d’autres encore, qui sont abordées dans le présent ouvrage.

Sociale media zijn alomtegenwoordig. Zowel in onze persoonlijke levenssfeer als op het werk, in familiale context of in onze hoedanigheid van consument zijn ze niet meer weg te denken. Door de democratische toegang tot sociale media, waarvoor men enkel een e-mailadres en een beperkte computerkennis nodig heeft, zijn sociale media uitgegroeid tot de grootste hype van het begin van deze eeuw. Hoewel de sociale media vele voordelen bieden, bleven inbreuken en misbruiken niet uit. De snelheid en dominantie waarmee sociale media hoe langer hoe meer ons internetgebruik sturen, roepen een brede waaier van juridische vragen op.Ouders stellen zich vragen over het socialemediagebruik van hun kinderen, consumenten over hun vrijheid en privacy, overheden over de gevaren van het circuleren van zoveel persoonsgegevens. Bedrijven onderzoeken de invloed van sociale media op hun klantenrelaties, op hun naam en reputatie. Ondernemers worstelen evenzeer met de bescherming van hun intellectuele eigendomen en zijn bovendien genoodzaakt positie in te nemen ten opzichte van het gebruik van sociale media door en voor hun werknemers. Regulatoren van hun kant zien nieuwe platformen ontstaan voor (kans)spelen, marketeers en headhunters daarentegen specialiseren zich in het gebruik ervan om zo direct mogelijk gebruikers te kunnen aanspreken.Dit boek laat onderzoekers en praktijkjuristen aan het woord, die vanuit het bestaande wettelijke kader en actuele rechtspraak dieper op deze vragen ingaan.
